By creating an account, accessing, or using SalesCal, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, along with our Privacy Policy, which is incorporated herein by reference.
If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and “you” refers to both you individually and the organization.

2. Eligibility
To use SalesCal, you must:
- Be at least 18 years of age or the age of legal majority in your jurisdiction

By using the Service, you represent and warrant that you meet all eligibility requirements. We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion if we reasonably believe that a user does not meet these requirements.
3. Account Registration

Security Notice: You are solely responsible for maintaining the confidentiality of your account credentials. We will not be liable for any loss or damage arising from your failure to protect your account information.
4. Service Description
SalesCal is an intelligent scheduling platform designed for businesses, professionals, and teams. Our Service includes, but is not limited to:
- Appointment Scheduling: Create and manage booking pages for appointments, meetings, and consultations
- Calendar Integration: Sync with Google Calendar, Microsoft 365, and other calendar providers
- Lead Qualification: Collect information from invitees before scheduling to qualify leads
- Round Robin Scheduling: Distribute appointments among team members based on availability and routing rules
- Automated Notifications: Send email and SMS reminders and confirmations to participants
- Analytics & Reporting: Track scheduling metrics and team performance
- Integrations: Connect with third-party applications and services
We continuously improve and update our Service. Features may be added, modified, or removed at our discretion. We will endeavor to provide notice of material changes that affect your use of the Service.
5. Subscriptions & Billing
5.1 Subscription Plans
SalesCal offers various subscription plans with different features and pricing tiers. Details of current plans and pricing are available on our website. By selecting a subscription plan, you agree to pay the applicable fees.
5.2 Billing Cycle
Subscriptions are billed in advance on a recurring basis according to your chosen billing cycle (monthly or annually). Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date.
5.3 Payment
You must provide valid payment information to subscribe to a paid plan. By providing payment information, you authorize us to charge your payment method for all fees associated with your subscription. You are responsible for keeping your payment information current.
5.4 Price Changes
We reserve the right to modify subscription fees at any time. Price changes will take effect at the beginning of your next billing cycle. We will provide reasonable notice of any price changes before they become effective. Your continued use of the Service after a price change constitutes acceptance of the new pricing.
5.5 Refunds
Except as required by applicable law, subscription fees are non-refundable. If you cancel your subscription, you will continue to have access to the Service until the end of your current billing period, but no refund will be issued for the remaining time.
6. Free Trial
We may offer a free trial period for new users to evaluate the Service. Free trial terms are as follows:
- You may be required to provide payment information to start a free trial
- You will not be charged during the free trial period
- If you do not cancel before the free trial ends, your subscription will automatically convert to a paid plan, and your payment method will be charged
- Free trials are limited to one per user or organization
- We reserve the right to modify or discontinue free trial offers at any time
To avoid being charged, you must cancel your subscription before the free trial period expires. You can cancel at any time through your account settings.
7. Fair Use Policy
Certain features of SalesCal, including notifications, SMS messages, and API access, are provided on a fair use basis. This means these features are intended for normal business use and are shared among our customer base.
7.1 General Fair Use
If your use of any feature places disproportionate demand on our systems or adversely affects other users’ experience, we reserve the right to:
- Contact you to discuss your usage patterns
- Implement usage limits on your account
- Suspend or restrict access to specific features
- Terminate your account in cases of severe or repeated abuse
7.2 SMS Notifications
If you use our SMS notification features, you agree to:
- Comply with all applicable laws and regulations regarding SMS communications
- Not send marketing or promotional content through appointment-related SMS
- Ensure that recipients have consented to receive SMS notifications
- Accept that SMS usage may be subject to monthly limits per user
We reserve the right to monitor SMS usage and restrict access if we determine that usage violates our fair use policy or applicable regulations.
8. Calendar Integration
SalesCal integrates with third-party calendar services, including Google Calendar and Microsoft 365. By connecting your calendar:
- You authorize us to access and read your calendar data to check availability
- You authorize us to create, modify, and delete calendar events on your behalf
- You acknowledge that calendar integrations are subject to the terms and availability of third-party providers
- You understand that disruptions to third-party calendar services may affect SalesCal functionality
We process calendar data in accordance with our Privacy Policy. You may disconnect calendar integrations at any time through your account settings.
9. Communications
By creating an account, you consent to receive communications from us, including:
- Transactional emails: Account confirmations, password resets, booking notifications
- Service updates: Important announcements about features, maintenance, or changes
- Marketing communications: Newsletters, promotional offers, and product updates (optional)
You can manage your communication preferences in your account settings or by clicking “unsubscribe” in marketing emails. Note that you cannot opt out of essential transactional and service-related communications while your account is active.
10. User Content
“User Content” refers to any content you create, upload, or share through the Service, including booking page text, form fields, images, branding elements, and messages.
10.1 Ownership
You retain ownership of your User Content. We do not claim ownership of any content you create or share through the Service.
10.2 License Grant
By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the Service. This license terminates when you delete your User Content or account, except where your content has been shared with others who have not deleted it.
10.3 Content Responsibility
You are solely responsible for your User Content and represent that:
- You own or have the necessary rights to use and share the content
- Your content does not violate any third-party rights, including intellectual property, privacy, or publicity rights

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that the results obtained from using the Service will be accurate or reliable.
No advice or information, whether oral or written, obtained from us or through the Service will create any warranty not expressly stated in these Terms.
15. Limitation of Liability
To the maximum extent permitted by law, in no event shall SalesCal, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, arising out of or related to your use of the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

17. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to:

- Fraudulent or illegal activity
- Non-payment of fees
- Extended periods of inactivity
- Requests by law enforcement
- Discontinuation of the Service
17.3 Effect of Termination
Upon termination:
- Your license to use the Service immediately terminates
- We may delete your account data after a reasonable period
- Provisions that should survive termination will remain in effect, including intellectual property rights, disclaimers, limitations of liability, and indemnification
