Invitee Terms

Introduction

These End User / Invitee Terms & Conditions (the “Invitee Terms”) govern your access to and use of any SalesCal-hosted scheduling page, booking link, embedded form, routing flow, or related end-user interface (collectively, the “Invitee Pages”) made available through the SalesCal platform (the “Service”).

Who we are. The Service is operated by Creative 6 Media Ltd, doing business as SalesCal (“SalesCal,” “we,” “us,” or “our”), a company registered in England & Wales with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom.

Our marketing site is at salescal.ai, the customer dashboard runs at app.salescal.ai, and Invitee Pages are typically served from subdomains of salescal.site.

Acceptance. By clicking “Book,” “Schedule,” “Submit,” “Continue,” or a similar control, or otherwise interacting with an Invitee Page, you agree to these Invitee Terms.

If you are using an Invitee Page on behalf of a company or other organization, you confirm that you are authorized to accept these Invitee Terms for that organization.

1. Definitions

“Customer” means the SalesCal account holder - for example, the business, coach, consultant, agency, or other organization - that created or configured the Invitee Page you are interacting with.

“Invitee” means an end user, lead, prospect, attendee, or visitor who uses an Invitee Page to request or schedule a meeting, submit information, or otherwise communicate with a Customer through the Service.

“Customer Personal Data” means the personal data you provide through, or that is collected in connection with, a Customer’s SalesCal scheduling link, booking page, or embedded form - including information needed to book, manage, reschedule, or cancel a meeting - together with the related scheduling and meeting metadata that SalesCal processes for that Customer.

2. Your relationship is with the Customer

2.1 The Customer controls the meeting and the offering

The meeting, services, and communications you request or receive are with the Customer, not with SalesCal.

The Customer is responsible for:

  • the services they offer or provide, including availability, pricing, quality, and fulfillment;
  • the content of their Invitee Pages, notices, qualification questions, and outbound communications; and
  • complying with the laws that apply to scheduling, marketing, and electronic communications, including email and SMS rules where relevant.

The Customer may turn on optional Service features, such as qualification logic, routing, lead enrichment, or scoring, to triage or prioritize requests.

The Customer chooses how and why those features are used and remains responsible for giving any required notices and for complying with applicable law.

2.2 SalesCal is a platform provider

SalesCal supplies the technology used to build and run Invitee Pages and to deliver scheduling-related communications.

SalesCal is not a party to any agreement between you and the Customer and is not responsible for the Customer’s acts or omissions.

2.3 The Customer’s own terms and notices apply to you

The Customer may publish their own terms, policies, and notices, including a privacy policy.

Those documents govern the Customer’s collection and use of your information and your relationship with the Customer.

Any SalesCal branding or links you may see on an Invitee Page, such as “Powered by SalesCal,” which links to salescal.ai, is provided for platform transparency only and does not replace the Customer’s own notices.

These Invitee Terms govern only your use of the Invitee Pages.

They do not govern the Customer’s services or any contract you may form with the Customer.

3. Eligibility

Invitee Pages are intended for individuals who are at least sixteen (16) years of age - or older where a higher minimum age is required by applicable law to consent to the processing of personal data or to use online services.

If you are under sixteen (16), or under the minimum age in your jurisdiction, please do not use Invitee Pages.

If you are between sixteen (16) and the age of majority in your jurisdiction, you may use Invitee Pages only with the involvement and consent of a parent or legal guardian where required by applicable law, and only where the Customer permits such use.

The Customer is responsible for ensuring that its use of Invitee Pages, including any collection or processing of personal data, complies with applicable law, including requirements relating to minors, notices, and consent.

4. Using Invitee Pages

4.1 Accuracy

You agree to provide accurate, current, and complete information when using an Invitee Page.

You are responsible for what you submit, including your contact details.

4.2 Acceptable use

You agree not to:

  • attempt to disrupt, probe, scan, or otherwise interfere with an Invitee Page or the Service;
  • submit malicious code, spam, harmful content, or abusive content;
  • impersonate another person or misrepresent your identity or affiliation; or
  • use any Invitee Page for unlawful, fraudulent, harassing, or deceptive purposes.

We may block, throttle, or restrict abusive activity to protect the Service, Customers, and other Invitees.

5. Scheduling and transactional communications

5.1 Confirmations, reminders, and updates

When you submit information through an Invitee Page, you may receive transactional communications relating to your booking.

For example:

  • confirmations;
  • reminders;
  • rescheduling notices;
  • cancellation notices; and
  • other booking-related updates.

These messages may be sent by the Customer using SalesCal as the delivery platform.

5.2 SMS / text messages (transactional only)

If an Invitee Page offers SMS updates and you provide a mobile number and opt in, where applicable, you may receive transactional SMS messages relating to your meeting.

For example:

  • confirmations; and
  • reminders.

Opt out: Where required or made available, you can opt out of SMS by replying STOP.

Effect: Opting out may stop further SMS reminders for your booking and could affect attendance reminders.

The Customer is responsible for the legal basis for, and required disclosures relating to, these communications.

Messages are sent by or on behalf of the Customer.

SalesCal acts as the delivery platform.

5.3 Delivery and availability

SalesCal does not guarantee that communications will be delivered without delay, interruption, or error.

Delivery can be affected by carrier or email-provider behavior, spam filtering, Customer configuration, or network issues.

6. Privacy and data processing

6.1 Customer Personal Data processed for the Customer

The information you submit through an Invitee Page, such as your name, email address, phone number, availability, and meeting details, is normally processed as Customer Personal Data for the Customer’s own purposes.

These purposes may include:

  • scheduling;
  • qualification; and
  • follow-up.

For Customer Personal Data submitted through an Invitee Page, the Customer is the data controller, and SalesCal processes that data only as a processor / service provider acting on the Customer’s behalf.

If you have questions or requests about how a Customer uses your information - including access, correction, deletion, or objection requests - please contact that Customer directly.

Customer-configured tracking technologies. A Customer may configure an Invitee Page to include third-party tracking or similar technologies, such as analytics pixels or marketing tags.

Examples include:

  • Meta Pixel; or
  • Hyros.

Those technologies are controlled by the Customer, and the Customer is responsible for providing any required notices and obtaining any required consents.

Where required, please review the privacy and cookie notices the Customer presents on, or links from, their Invitee Page.

Cookies and similar technologies used on SalesCal-controlled pages are governed by the SalesCal Cookie Policy.

Cookies, pixels, or similar technologies implemented by a Customer, or by third parties at a Customer’s direction, on Invitee Pages are governed by that Customer’s and/or the applicable third party’s terms and privacy practices.

6.2 SalesCal operational data

SalesCal may process limited technical and security information needed to operate, secure, troubleshoot, and maintain the Service.

For example:

  • basic request logs; and
  • security events.

This processing is described in the SalesCal Privacy Policy.

6.3 External links

Invitee Pages may link to third-party websites and services.

SalesCal does not control those third parties and is not responsible for their content or practices.

7. Third-party services and integrations

Depending on how a Customer configures their Invitee Page, the Page may include or generate links to third-party services.

Examples include:

  • video-conferencing links, such as Zoom or Google Meet;
  • calendar services, such as Google Calendar;
  • CRM systems, such as HubSpot, Close, Pipedrive, or GoHighLevel;
  • messaging tools, such as Slack; or
  • mapping services.

Your use of any such third-party service is subject to that third party’s own terms and policies.

SalesCal is not responsible for those services.

8. Intellectual property

The Invitee Pages and the Service, including the underlying software, design, and SalesCal branding, are owned by SalesCal or its licensors and are protected by intellectual property laws.

Subject to these Invitee Terms, SalesCal grants you a limited, non-exclusive, non-transferable, revocable license to access and use Invitee Pages solely for the personal or internal business purpose of interacting with the relevant Customer.

9. Disclaimers

Invitee Pages and the Service are provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, SalesCal disclaims all warranties, whether express, implied, or statutory - including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

SalesCal does not warrant that Invitee Pages will be uninterrupted, timely, secure, or error-free, or that the Customer will accept, confirm, attend, or honor any meeting request.

10. Limitation of liability

To the maximum extent permitted by law:

  • SalesCal will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to the Invitee Pages or these Invitee Terms.
  • SalesCal’s total aggregate liability arising out of or relating to the Invitee Pages or these Invitee Terms will not exceed US $100 - or, if a higher cap is required by applicable law, the minimum amount permitted by that law.

Some jurisdictions do not allow certain limitations of liability, so the limitations above may not apply to you in full to the extent prohibited by applicable law.

11. Indemnification

You will be responsible for any losses, damages, or costs incurred by SalesCal that arise from your unlawful use of the Invitee Pages.

This includes:

  • misuse;
  • fraud;
  • deliberate disruption; or
  • intentional abuse of the Service.

12. Governing law and venue

Governing law. These Invitee Terms are governed by and construed in accordance with the laws of England & Wales, excluding its conflict-of-laws rules.

Nothing in these Invitee Terms limits any rights or protections you may have under the mandatory laws of the country or jurisdiction where you reside.

Venue. To the extent permitted by applicable law, any dispute arising out of or relating to these Invitee Terms or the Invitee Pages will be subject to the exclusive jurisdiction of the courts of England & Wales, and you consent to personal jurisdiction and venue in those courts.

This provision does not prevent you from bringing claims in a court that has jurisdiction in the place where you live, where that right cannot be waived under applicable law.

13. Miscellaneous

Independent relationship. Nothing in these Invitee Terms creates a partnership, joint venture, employment, fiduciary, or agency relationship between you and SalesCal.

Severability. If any provision of these Invitee Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

No third-party beneficiaries. These Invitee Terms are entered into for the benefit of you and SalesCal only.

Assignment. You may not assign these Invitee Terms without SalesCal’s prior written consent.

SalesCal may assign these Invitee Terms in connection with a merger, acquisition, reorganization, or sale of all or substantially all of its assets.

Force majeure. SalesCal is not liable for delays or failures caused by events beyond its reasonable control - including internet outages, denial-of-service attacks, and failures of third-party providers.

14. Changes to these Invitee Terms

We may update these Invitee Terms from time to time.

When we do, we will post the updated version with a new “Last revised” date.

Your continued use of any Invitee Page after the effective date of an update will constitute your acceptance of the updated Invitee Terms, to the extent permitted by applicable law.
